India: India's FSSAI Publishes Draft Amendments for Advertising and Claims Regulations

On December 27, 2021, the Ministry of Health and Family Welfare/Food Safety and Standards Authority of India (FSSAI) issued Notification No. F. No. Std/SP-08/A-1.2020/N-03 (see, Appendix I). The notification, was published in the Gazette of India (official gazette) on December 27, 2021, notifying draft amendments to the Food Safety and Standards (Advertising and Claims) Regulations (2018). Amendments include a general principles for claims; nutrition claims; non-addition claims; procedure for redressal of non-compliance; Schedule-I on nutrient content claim; and Schedule-II on synonyms used for claims defined in the regulation. World Trade Organization (WTO) members are invited to comment on the proposed draft amendment; the timeline to provide comments is 60-days from the date of notification on the WTO website.
