- OFFERORS MUST CHECK WITH THE FACILITY TO OBTAIN INFORMATION ON FACILITY'S
CAPABILITY FOR LOADING CONTAINERS. WITHOUT GUARANTEE, CHARTERER HAS BEEN
ADVISED THAT HOURS FOR LOADING CONTAINERS AT THE FACILITY ARE BETWEEN 7:00
A.M. - 2:00 P.M. MONDAYS THROUGH FRIDAYS ONLY WITH WEEKENDS AND HOLIDAYS
EXCLUDED; SUPPLIER ADVISES THAT THEY CAN LOAD 4-5 CONTAINERS (LIVE LOAD)
PER DAY IF ONE FACILITY AND 8-10 PER DAY (LIVE LOAD) IF TWO FACILITIES
USED.
FOR ANY COMMODITIES ALLOCATED BASIS INTERMODAL SUPPLIER'S PLANT, VESSEL
OWNERS MUST COMPLY WITH SUPPLIER'S LOAD AND CAPACITY CAPABILITIES. IF THE
VESSEL FAILS TO COMPLY WITH SUPPLIER'S LOAD CAPABILITIES, ANY COSTS
INCURRED BY CCC INCLUDING BUT NOT LIMITED TO CARRYING CHARGES, LIQUIDATED
DAMAGES, STORAGE, WILL BE FOR THE VESSEL'S ACCOUNT. IF CONTAINERS ARE
PLACED AT THE SUPPLIER'S PLANT, CARRIER MUST ENSURE THAT CONTAINERS ARE
PLACED AT THE PLANT BY THE COMMENCEMENT OF THE SUPPLIER'S SHIPPING PERIOD
AND SUPPLY CONTAINERS ON A CONTINUOUS BASIS UNTIL THE SUPPLIER FULFILLS HIS
CONTRACT QUANTITY. OWNERS ARE RESPONSIBLE TO OFFER ONLY FOR VENDORS WHO
MATCH OWNER'S CAPABILITIES. IF SUPPLIER FAILS TO PROVIDE COMMODITY FOR
LOADING DURING THE SPECIFIED SHIPPING PERIOD (OR BEYOND ALLOWABLE FREE
TIME) DEMURRAGE, IF ANY, WILL BE FOR THE ACCOUNT OF SUPPLIERS.

- ANY ADDITIONAL COMPLETION CARGO(ES) MUST BE DULY SEPARATED, MUST BE
COMPATIBLE AND NON-INJURIOUS TO IRD'S SOY-FLOUR CARGO(ES), MUST BE DETAILED
IN OFFER OR APPROVED BY CHARTERERS/USDA/USAID IF CONTRACTED AFTER FIXTURE
OF IRD'S SOY-FLOUR CARGO(ES).
- OFFERS OF NAMED VESSELS ONLY; NO VESSEL SUBSTITUTION IS PERMITTED WITHOUT
CHARTERERS/USDA'S APPROVAL.

- OWNERS GUARANTEE THAT THIS VESSEL COMPLIES FULLY WITH THE INTERNATIONAL
SAFETY MANAGEMENT (ISM) CODE, IF REQUIRED, AND IS IN POSSESSION OF A VALID
DOCUMENT OF COMPLIANCE AND SAFETY MANAGEMENT CERTIFICATE AND WILL REMAIN SO
FOR THE ENTIRETY OF HER EMPLOYMENT UNDER THIS CHARTER PARTY. OWNERS ARE TO
PROVIDE CHARTERERS WITH SATISFACTORY EVIDENCE OF COMPLIANCE IF REQUIRED
TO DO SO AND TO REMAIN FULLY RESPONSIBLE FOR ANY AND ALL CONSEQUENCES
RESULTING DIRECTLY OR INDIRECTLY FROM ANY MATTERS ARISING IN CONNECTION
WITH THIS VESSEL AND THE ISM CODE.
- SECTION 408 OF THE COAST GUARD AUTHORIZATION ACT OF 1998, PUBLIC LAW
105-383 (46 U.S.C., PARAGRAPH 2302(E)), ESTABLISHES EFFECTIVE JANUARY 1,
1999, WITH RESPECT TO NON-U.S. FLAG VESSELS AND OPERATORS/OWNERS, THAT
SUBSTANDARD VESSELS AND VESSELS OPERATED BY OPERATORS/OWNERS OF SUBSTANDARD
VESSELS ARE PROHIBITED FROM THE CARRIAGE OF GOVERNMENT IMPELLED
(PREFERENCE) CARGO(ES) FOR UP TO ONE YEAR AFTER SUCH SUBSTANDARD
DETERMINATION HAS BEEN PUBLISHED ELECONTRONICALLY. AS THE CARGO ADVERTISED
IN THIS RFP IS A GOVERNMENT IMPELLED (PREFERENCE) CARGO, OFFEROR MUST
WARRANT THAT VESSEL(S) AND OWNERS/OPERATORS ARE NOT DISQUALIFIED TO CARRY
SUCH GOVERNMENT IMPELLED (PREFERENCE) CARGO(ES).
- AT INLAND PLANT(S), CARGO IS TO BE STUFFED (LOADED) INTO CONTAINERS AT
COMMODITY SUPPLIER'S TIME, RISK AND EXPENSE. OWNERS/CARRIER MUST PROVIDE
CONTAINERS AT THEIR EXPENSE AND CERTIFY THAT EACH CONTAINER UTILIZED TO
LOAD IRD'S CARGO IS IN WIND AND WATER TIGHT CONDITION, HAS METAL FLOOR, IS
NO MORE THAN TEN (10) YEARS OLD, AND IS NOT A SALVAGED CONTAINER OR
MUSTERED OUT FROM REGULAR SERVICE. AS A CONDITION OF PAYMENT,
OWNERS/CARRIER MUST PROVIDE AN INDEPENDENT SURVEY REPORT ATTESTING TO THE
SATISFACTORY CONDITION OF CONTAINERS. SURVEY IS TO BE PERFORMED PRIOR TO
LOADING IRD'S CARGOES. OWNERS TO APPOINT AND PAY STEVEDORES AT LOAD
PORT(S).
- LOADING TERMS: THE CARGO IS TO BE LOADED TO OCEAN GOING VESSEL ACCORDING
TO BERTH TERMS WITH NO DEMURRAGE/NO DESPATCH/NO DETENTION.
- DISCHARGING TERMS: THE CONTAINERIZED BAGGED CARGO IS TO BE DISCHARGED
ACCORDING TO BERTH TERMS WITH NO DEMURRAGE/NO DESPATCH/NO DETENTION.
OWNER/CARRIER IS TO ALLOW CHARTERER/RECEIVER FIFTEEN (15) DAYS FREE TIME
FOR STRIPPING OF CONTAINER. CHARTERER/RECEIVER MAY AT THEIR OPTION MOVE
CONTAINER AT THEIR EXPENSE TO OTHER LOCATIONS WITHIN OR OUTSIDE JAKARTA FOR
STRIPPING. OFFER IS TO SPECIFY DAILY CONTAINER DEMURRAGE RATE SHOULD A
CONTAINER NOT BE RETURNED TO OWNER/CARRIER WITHIN THE FIFTEEN DAY FREE TIME
PERIOD. SUCH CONTAINER DEMURRAGE CHARGES WOULD BE FOR CHARTERER/RECEIVER'S
ACCOUNT.
- COMPULSORY CRANE HIRE CHARGES AT DISCHARGE PORT(S), IF APPLICABLE,
ARE FOR OWNERS' ACCOUNT.
- VESSELS ARRIVING WITH EXCESS DRAFT MAY BE SUBJECT TO FINES AT DISCHARGE
PORT(S) AND SUCH FINES WILL BE SOLELY FOR OWNERS' ACCOUNT IF LEVIED.
- OWNERS ARE RESPONSIBLE FOR VESSEL ARRIVING AT DISCHARGE PORT MEETING THE
PORT'S VESSEL RESTRICTIONS. ANY LIGHTENING REQUIRED AS A RESULT OF
VESSEL'S FAILURE TO ARRIVE AT DISCHARGE PORT IN ACCORDANCE WITH THE PORT'S
VESSEL RESTRICTIONS IS FOR OWNERS' TIME, RISK AND EXPENSE. LIGHTENING, IF
REQUIRED, TO BE ACCOMPLISHED IN THE TERRITORIAL WATERS OF INDONESIA.
LIGHTENING MUST BE INTO DAUGHTER VESSEL(S) WHICH MUST BE SUITABLE TYPE
VESSELS FOR CONTAINERIZED BAGGED DEFATTED SOY-FLOUR, AND MUST MEET VESSEL
RESTRICTIONS/GEAR REQUIREMENTS FOR DISCHARGE PORT(S).

CONSTRUCTION, NOT REBUILT DATE, TO GOVERN.
- ONE WAY RATES MUST BE QUOTED IN ADDITION TO ROUND TRIP RATES FOR U.S.
FLAG NON-LINER VESSELS WHOSE DATE OF ORIGINAL CONSTRUCTION EXCEEDS 15 YEARS
FROM DATE AT FIXTURE.
- U.S. FLAG APPROVED RATES WILL BE REDUCED TO A LEVEL NO HIGHER THAN THE
MARITIME ADMINISTRATION FAIR AND REASONABLE RATE IN THE EVENT THAT APPROVED
VESSEL IS SUBSTITUTED BY A LOWER COST VESSEL TO THE U.S. GOVERNMENT
(INCLUDING TUG AND/OR BARGE).
FOR U.S. FLAG VESSELS LOADING LESS THAN A FULL CARGO, THE LESS THAN FULL
CARGO FREIGHT RATE WILL BE SUBJECT TO A REDUCTION TO MEET ANY REVISED
MARITIME ADMINISTRATION FREIGHT RATE GUIDELINE DUE TO VESSEL LOADING OTHER
ADDITIONAL CARGO.
- U.S. FLAG OFFERS WILL NOT BE CONSIDERED IF THE VESSEL OPERATOR HAS NOT
PROVIDED THE MARITIME ADMINISTRATION WITH THE VESSEL'S COSTS PRIOR TO
SUBMISSION OF OFFER.
- IRD RESERVES THE RIGHT TO ACCEPT OR REJECT OFFERS.
- SHOULD GENERAL AVERAGE CONDITIONS ARISE, CHARTERERS SHALL ASSIGN THEIR
RIGHTS TO THE USDA/DEBT MANAGEMENT SECTION, WHO IN TURN SHALL CONTRIBUTE
WITH THE OWNERS IN GENERAL AVERAGE TO THE PAYMENT OF ANY SACRIFICES, LOSSES
OR EXPENSES OF A GENERAL AVERAGE NATURE THAT MAY BE INCURRED INCLUDING
SALVAGE AND SPECIAL CHARGES INCURRED IN RESPECT TO THE GOODS. IF A SALVING
SHIP IS OWNED OR OPERATED BY THE OWNERS, SALVAGE SHALL BE PAID FOR AS FULLY
AS IF THE SAID SALVING SHIP OR SHIPS BELONGED TO STRANGERS. GENERAL
AVERAGE SHALL BE PAYABLE ACCORDING TO YORK/ANTWERP RULES, 1974. CARGO TO
BE RELEASED WITHOUT GENERAL AVERAGE SECURITY.
- THE UNITED STATES DEPARTMENT OF AGRICULTURE KANSAS CITY COMMODITY
OFFICE'S GUIDELINES DATED DECEMBER 21, 1989 FOR CONTAINER, BARGE AND
VESSEL HOLD INSPECTIONS IS HEREBY INCORPORATED.

OFFICE'S NOTICE TO THE TRADE DATED JULY 5, 1996, REGARDING CHANGES IN THE
