D.F. YOUNG, WASHINGTON, D.C. FOR AND ON BEHALF OF CATHOLIC RELIEF SERVICES (CRS) REQUESTS OFFERS OF U.S. AND NON-U.S. FLAG VESSELS FOR THE CARRIAGE OF BULK WHEAT FINANCED UNDER THE SECTION 416(B) PROGRAM (GLOBAL FOOD FOR EDUCATION INITIATIVE) ON THE FOLLOWING BASIS:

- IFB NO. HO-CRS-416(B)-02-002
- CARGO(ES): APPROXIMATELY 7,400 MT WHEAT IN BULK (UP TO TWO GRADES / CLASSES). CHARTERER'S INTENTION WITHOUT GUARANTEE IS 5,400 MT OF HRW WHEAT AND 2,000 MT OF SRW WHEAT. 
- COST OF SEPARATIONS, IF REQUIRED, IS FOR OWNER'S ACCOUNT. IF ARTIFICIAL SEPARATIONS ARE REQUIRED, OWNER TO UTILIZE PLYWOOD IN MAKING THE SEPARATIONS IN ORDER TO AVOID ANY COMMINGLING OF DIFFERENT GRADES/CLASSES OF WHEAT AT LOAD AND IN THE DISCHARGE PROCESS.
- CARGO QUANTITIES WILL BE CONTRACTED ON MIN/MAX BASIS.
- LAYCAN: JAN 28-FEB 6, 2002.
- OFFERORS SHOULD CONSIDER OFFERING VESSELS TO CARRY A WIDE RANGE OF TONNAGES TO ACCOMMODATE THE PROGRAM NEEDS. 
- ANY ADDITIONAL COMPLETION CARGO(ES) MUST BE DULY SEPARATED, MUST BE COMPATIBLE AND NON-INJURIOUS TO CRS' SECTION 416(B) WHEAT CARGO(ES), MUST BE DETAILED IN OFFER OR APPROVED BY CHARTERERS/USDA IF CONTRACTED AFTER FIXTURE OF CRS' SECTION 416(B) WHEAT CARGO(ES). VESSEL'S ITINERARY AND GEOGRAPHIC PROXIMITY OF COMPLETION CARGO(ES) WILL BE TAKEN INTO CONSIDERATION BY CHARTERER/USDA IN APPROVAL OF SUCH PART CARGO(ES) IN ORDER NOT TO UNDULY IMPEDE DELIVERY OF CRS' CARGO(ES) TO HONDURAS.
- OFFERS RECEIVED WITH LAYDAYS BEYOND CANCELING DATE WILL NOT BE CONSIDERED.
- OFFERS OF NAMED VESSELS ONLY; NO VESSEL SUBSTITUTION IS PERMITTED WITHOUT CHARTERER'S/USDA'S APPROVAL.
- OWNERS GUARANTEE THAT THIS VESSEL COMPLIES FULLY WITH THE INTERNATIONAL SAFETY MANAGEMENT (ISM) CODE, IF REQUIRED, AND IS IN POSSESSION OF A VALID DOCUMENT OF COMPLIANCE AND SAFETY MANAGEMENT CERTIFICATE AND WILL REMAIN SO FOR THE ENTIRETY OF HER EMPLOYMENT UNDER THIS CHARTER PARTY. OWNERS ARE TO PROVIDE CHARTERERS WITH SATISFACTORY EVIDENCE OF COMPLIANCE IF REQUIRED TO DO SO AND TO REMAIN FULLY RESPONSIBLE FOR ANY AND ALL CONSEQUENCES RESULTING DIRECTLY OR INDIRECTLY FROM ANY MATTERS ARISING IN CONNECTION WITH THIS VESSEL AND THE ISM CODE.
- SECTION 408 OF THE COAST GUARD AUTHORIZATION ACT OF 1998, PUBLIC LAW 105-383 (46 U.S.C., PARAGRAPH 2302(E)), ESTABLISHES EFFECTIVE JANUARY 1, 1999, WITH RESPECT TO NON-U.S. FLAG VESSELS AND OPERATORS / OWNERS, THAT SUBSTANDARD VESSELS AND VESSELS OPERATED BY OPERATORS / OWNERS OF SUBSTANDARD VESSELS ARE PROHIBITED FROM THE CARRIAGE OF GOVERNMENT IMPELLED (PREFERENCE) CARGO(ES) FOR UP TO ONE YEAR AFTER SUCH SUBSTANDARD DETERMINATION HAS BEEN PUBLISHED ELECONTRONICALLY. AS THE CARGO ADVERTISED IN THIS IFB IS A GOVERNMENT IMPELLED (PREFERENCE) CARGO, OFFEROR MUST WARRANT THAT VESSEL(S) AND OWNER / OPERATOR ARE NOT DISQUALIFIED TO CARRY SUCH GOVERNMENT IMPELLED (PREFERENCE) CARGO(ES).

- DISCHARGING TERMS: THE CARGO IS TO BE DISCHARGED BY RECEIVER, FREE OF RISK AND EXPENSE TO THE VESSEL AT THE AVERAGE RATE OF 1,500 TONS OF 2,204.6 POUNDS FOR BULK CARRIERS AND 1,200 TONS OF 2,204.6 POUNDS FOR MULTIDECKERS AND TANKERS, PER WEATHER WORKING DAYS OF 24 CONSECUTIVE HOURS SUNDAYS AND HOLIDAYS EXCEPTED, EVEN IF USED, ON THE BASIS OF THE BILL OF LADING QUANTITY. SATURDAYS PER BFC SATURDAY CLAUSE. LASH/SEABEE BARGES: THE DISCHARGE GUARANTEE SHALL NOT APPLY.
- RECEIVERS TO APPOINT AND PAY STEVEDORES AT PORTS OF DISCHARGE. 
- VESSEL GEAR REQUIREMENTS: VESSELS MUST BE CAPABLE OF SELF-DISCHARGE WITH VESSEL'S OR OWNER SUPPLIED SHORESIDE GEAR (CRANES AND/OR SWINGING DERRICKS WITH MINIMUM 8 MT S.W.L. CAPACITY SUITABLE FOR CLAMSHELL DISCHARGE), AND/OR WITH VACUVATORS INCLUDING ALL NECESSARY VACUVATOR PIPES AND SUPPORTS FOR PIPES AND/OR WITH MARINE LEGS INCLUDING ALL NECESSARY SUPPORT EQUIPMENT. ALL DISCHARGE GEAR AND EQUIPMENT IS TO BE SUPPLIED BY OWNER AT OWNER'S EXPENSE. OWNERS TO PROVIDE AT THEIR EXPENSE ALL NECESSARY MOTIVE POWER/FUEL TO OPERATE ALL DISCHARGE GEAR AS WELL AS TECHNICIANS IN THE CASE OF VACUVATORS AND MARINE LEGS TO OVERSEE THEIR OPERATION. DISCHARGE GEAR PROVIDED BY OWNER/VESSEL MUST BE CAPABLE OF MAINTAINING THE GUARANTEED AVERAGE DISCHARGE RATE AS SPECIFIED ABOVE IN DISCHARGING TERMS CLAUSE. ANY TIME LOST AS A RESULT OF BREAKDOWN OF VESSEL'S GEAR AND/OR VACUVATORS AND/OR MARINE LEGS TO BE EXCLUDED FROM LAYTIME USED. VESSELS ARE TO BE FULLY EQUIPPED WITH DISCHARGE GEAR / EQUIPMENT PRIOR TO RECEIVER'S ACCEPTANCE OF THE NOTICE OF READINESS TO DISCHARGE. 

OPENING AND CLOSING OF HATCHES TO BE CARRIED OUT BY VESSEL'S CREW FREE 
OF CHARGE TO CHARTERERS. MECHANICAL OR HYDRAULIC HATCH COVERS FOR VESSELS OR RAIN TENTS FOR ALL HATCHES ARE REQUIRED.
- DISCHARGE PORT RESTRICTION: MAX DRAFT 30 FT S.W. OWNERS ARE RESPONSIBLE FOR VESSEL ARRIVING AT DISCHARGE PORT NOT EXCEEDING DISCHARGE PORT MAXIMUM S.W. DRAFT RESTRICTION. ANY LIGHTENING REQUIRED AS A RESULT OF VESSEL'S FAILURE TO ARRIVE AT DISCHARGE PORT IN ACCORDANCE WITH STATED RESTRICTION IS FOR OWNER'S TIME, RISK AND EXPENSE. LIGHTENING, IF REQUIRED, TO BE ACCOMPLISHED IN THE TERRITORIAL WATERS OF HONDURAS.
- DEMURRAGE/DESPATCH IS APPLICABLE AT LOAD AND DISCHARGE PORTS. OWNERS ARE TO SPECIFY DEMURRAGE/DESPATCH RATES IN THEIR OFFER. DESPATCH RATES MUST BE ONE-HALF OF DEMURRAGE RATES QUOTED. LAYTIME IS NON-REVERSIBLE.
- LAYTIME ACCOUNTS ARE TO BE SETTLED DIRECTLY BETWEEN OWNERS AND  COMMODITY SUPPLIER(S) AT LOAD PORT(S). LAYTIME CALCULATION, OVERTIME AND TRIMMING TO BE IN ACCORDANCE TO ADDENDUM NO. 1 OF THE NORTH AMERICAN EXPORT GRAIN ASSOCIATION, INC. F.O.B. CONTRACT NO. 2 (REVISED AS OF AUGUST 1, 1988) CLAUSES NOS. 1-10 INCLUSIVE, (HEREINAFTER "N.A.E.G.A.") REGARDLESS OF TYPE OF VESSEL. FURTHER, THE FOLLOWING MODIFICATIONS TO N.A.E.G.A. WILL APPLY: ANYWHERE THE WORD "BUYER" APPEARS, THE WORDS "VESSEL OWNER" SHOULD BE SUBSTITUTED IN ITS PLACE. UNDER NO CIRCUMSTANCES SHALL CHARTERER OR USDA/CCC BE RESPONSIBLE FOR RESOLVING DISPUTES INVOLVING THE CALCULATION OF LAYTIME OR THE PAYMENT OF DEMURRAGE OR DESPATCH BETWEEN THE VESSEL OWNERS AND THE COMMODITY SUPPLIER(S). ANY/ALL DISPUTES BETWEEN VESSEL OWNERS AND THE COMMODITY SUPPLIER(S) ARISING OUT OF THIS CONTRACT RELATING TO THE SETTLEMENT OF LAYTIME ISSUES SHALL BE ARBITRATED IN NEW YORK SUBJECT TO THE RULES OF THE SOCIETY OF MARITIME ARBITRATORS, INC. 
- DISCHARGE PORT LAYTIME ACCOUNTS ARE TO BE SETTLED DIRECTLY BETWEEN RECEIVERS AND VESSEL OWNER. VESSEL OWNER IS TO PREPARE AND SUBMIT SIGNED DISCHARGE PORT LAYTIME STATEMENT TO RECEIVERS, WITH COPY TO CHARTERER'S AGENTS, D.F. YOUNG, FOR APPROVAL WITHIN THIRTY DAYS OF COMPLETION OF DISCHARGE. DISCHARGE PORT NOTICE OF READINESS AND DISCHARGE PORT STATEMENT OF FACTS, BOTH SIGNED ON BEHALF OF RECEIVERS AND VESSEL OWNER ARE TO BE PRESENTED WITH SIGNED DISCHARGE PORT LAYTIME STATEMENT. UNDER NO CIRCUMSTANCES SHALL CCC OR CHARTERERS BE RESPONSIBLE FOR RESOLVING DISPUTES INVOLVING THE CALCULATION OF LAYTIME OR THE PAYMENT OF DEMURRAGE OR DESPATCH BETWEEN RECEIVERS AND THE VESSEL OWNER. ANY/ALL DISPUTES BETWEEN RECEIVERS AND VESSEL OWNER ARISING OUT OF THIS CONTRACT RELATING TO THE SETTLEMENT OF LAYTIME ISSUES SHALL BE ARBITRATED IN NEW YORK SUBJECT TO THE RULES OF THE SOCIETY OF MARITIME ARBITRATORS, INC.
- AT THE DISCHARGE PORT AND UPON INSPECTION BY GOVERNMENT INSPECTORS, IF CARGO AND/OR VESSEL IS FOUND TO BE INFESTED AND PROVIDED CLEAN BILL(S) OF LADING WERE ISSUED, FUMIGATION COSTS IF ANY ARE FOR OWNER'S (VESSEL'S) ACCOUNT, TIME COUNTING ON U.S. FLAG VESSELS AND NOT COUNTING ON NON-U.S. FLAG VESSELS. 
- FOREIGN FLAG VESSELS SHOULD NOT BE OLDER THAN 20 YEARS AND MUST BE CLASSED HIGHEST IN LLOYD'S REGISTER OR ITS EQUIVALENT. DATE OF ORIGINAL CONSTRUCTION, NOT REBUILT DATE, TO GOVERN. ANY EXTRA INSURANCE ON ACCOUNT OF VESSEL'S AGE, FLAG, OWNERSHIP, TYPE, CONFIGURATION, CLASSIFICATION WILL BE FOR OWNER'S ACCOUNT, BUT NOT EXCEEDING NEW YORK MARKET RATES.
- VESSELS 15 YEARS AND OLDER, TOWED BARGES, AND PUSH-MODE ITB UNITS MUST HAVE ALL OPENINGS TO CARGO SPACES AND HATCHES' COVERS TIGHTLY SEALED WITH TAPE OR BY OTHER MEANS TO ASSURE WATER TIGHT INTEGRITY. THE SEALING SHALL BE DONE TO THE SATISFACTION OF ATTENDING NCB SURVEYOR AS ATTESTED BY A SPECIAL SURVEY. COST OF SEALING HATCH COVERS/OPENINGS TO CARGO SPACES AS WELL AS SPECIAL SURVEY FEES SHALL BE FOR VESSEL OWNER'S ACCOUNT. SPECIAL SURVEY CERTIFICATE SHALL IN NO WAY DIMINISH OWNER'S LIABILITY AND RESPONSIBILITIES TOWARD THE CARGO. - ONE WAY RATES MUST BE QUOTED IN ADDITION TO ROUND TRIP RATES FOR U.S. FLAG NON-LINER VESSELS WHOSE DATE OF ORIGINAL CONSTRUCTION EXCEEDS 15 YEARS FROM THE DATE OF FIXTURE.
- U.S. FLAG APPROVED RATES WILL BE REDUCED TO A LEVEL NO HIGHER THAN  THE MARITIME ADMINISTRATION FAIR AND REASONABLE RATE IN THE EVENT THAT APPROVED VESSEL IS SUBSTITUTED BY A LOWER COST VESSEL TO THE U.S. GOVERNMENT (INCLUDING TUG AND/OR BARGE). FOR U.S. FLAG VESSELS LOADING LESS THAN A FULL CARGO, THE LESS THAN FULL CARGO FREIGHT RATE WILL BE SUBJECT TO A REDUCTION TO MEET ANY REVISED MARITIME ADMINISTRATION FREIGHT RATE GUIDELINE DUE TO VESSEL LOADING OTHER ADDITIONAL CARGO. 
- U.S. FLAG OFFERS WILL NOT BE CONSIDERED IF THE VESSEL OPERATOR HAS NOT PROVIDED THE MARITIME ADMINISTRATION WITH THE VESSEL'S COSTS PRIOR TO SUBMISSION OF OFFER. 
- CRS RESERVES THE RIGHT TO ACCEPT OR REJECT OFFERS.
