- OFFERORS MUST CHECK WITH THE INLAND PLANT FACILITY TO DETERMINE WHAT TYPE
OF CONVEYANCE IS ACCEPTABLE AT THE INLAND PLANT FACILITY AS WELL AS THEIR
CAPABILITY FOR LOADING CONTAINERS.

- OFFERORS ARE TO PROVIDE A DETAILED ITINERARY OF THE SERVICE BEING OFFERED
IN THEIR OFFER WHICH SHALL INCLUDE LOAD PORT(S) TO BE UTILIZED, ESTIMATED
LOAD DATES, ESTIMATED SAILING DATES FROM LOAD PORT(S), ESTIMATED TRANSIT
TIMES INCLUDING ANY PROJECTED INTERIM PORTS, AND ESTIMATED ETA AT FIRST OR
SOLE DISCHARGE PORT.
- OFFERORS SHOULD CONSIDER OFFERING VESSELS TO CARRY A RANGE OF TONNAGES.
CARRIERS OFFERING FOR A RANGE OF TONNAGES MUST SUBMIT AN OFFER IN
INCREMENTS OF 1000 MT BEGINNING WITH THE MINIMUM TONNAGE UP TO THE MAXIMUM
TONNAGE. CARRIERS WISHING TO BE CONSIDERED FOR A SPECIFIC TONNAGE ON A
MIN/MAX BASIS ONLY SHOULD SUBMIT ONE RATE FOR THAT TONNAGE.
- COMMODITY, LOAD PORT AND INTERMODAL POINT ABBREVIATIONS AS PER USDA FORM
KC-362. DELIVERY TERMS PER USDA NOTICE TO THE TRADE OF APRIL 5, 1995.
- THE BAGGED NONFAT DRY MILK IS TO BE CONTAINERIZED AND OFFERS OF
NON-CONTAINERIZED SERVICE WILL NOT BE CONSIDERED RESPONSIVE TO THIS FREIGHT
IFB.
- CONTAINERIZED SHIPMENTS SHALL HAVE NO MORE THAN ONE TRANSSHIPMENT ENROUTE
TO INDONESIA. DIRECT SERVICE IS PREFERRED. OFFERORS ARE TO DETAIL THEIR
CONTAINER TRACKING SYSTEM IN THEIR OFFER.
- OWNER/CARRIER MUST CERTIFY THAT EACH CONTAINER UTILIZED TO LOAD NFD MILK
CARGO IS IN WIND AND WATER TIGHT CONDITION, HAS A METAL FLOOR, IS NOT MORE
THAN TEN (10) YEARS OLD, AND IS NOT A SALVAGED CONTAINER OR MUSTERED OUT
FROM REGULAR SERVICE. AS A CONDITION OF PAYMENT, OWNER/CARRIER MUST
PROVIDE AN INDEPENDENT SURVEY REPORT ATTESTING TO THE SATISFACTORY
CONDITION OF CONTAINERS. SURVEY IS TO BE PERFORMED PRIOR TO LOADING NFD
MILK CARGOES. NO CONTAINER MINIMUMS SHALL APPLY.
- OFFERS OF NAMED VESSELS ONLY; NO VESSEL SUBSTITUTION IS PERMITTED WITHOUT
SHIPPER'S/USDA'S APPROVAL.
- AS THE CARGO ADVERTISED IN THIS IFB IS A GOVERNMENT IMPELLED (PREFERENCE)
CARGO, OFFERORS OF NON-U.S. FLAG VESSELS MUST WARRANT THAT VESSEL(S) AND
OWNER / OPERATOR ARE NOT DISQUALIFIED TO CARRY SUCH GOVERNMENT IMPELLED
(PREFERENCE) CARGO(ES) AS OUTLINED IN SECTION 408 OF THE COAST GUARD
AUTHORIZATION ACT OF 1998, PUBLIC LAW 105-383 (46 U.S.C., PARAGRAPH

- LOADING TERMS: THE CARGO IS TO BE LOADED ACCORDING TO BERTH TERMS WITH
NO DEMURRAGE/NO DESPATCH/NO DETENTION.
- COMPLIANCE TO COMMODITY SUPPLIER'S LOAD CAPABILITIES: FOR ANY
COMMODITIES ALLOCATED BASIS INTERMODAL SUPPLIER'S PLANT, CARRIER MUST
COMPLY WITH COMMODITY SUPPLIER'S LOAD AND CAPACITY CAPABILITIES. IF THE
VESSEL FAILS TO COMPLY WITH COMMODITY SUPPLIER'S LOAD CAPABILITIES, ANY
COSTS INCURRED BY THE VENDOR/USDA (CCC) INCLUDING BUT NOT LIMITED TO
LIQUIDATED DAMAGES, STORAGE, WILL BE FOR CARRIER'S ACCOUNT. IF
CONTAINERS/RAILCARS/TRUCKS WILL BE PLACED AT THE COMMODITY SUPPLIER'S
PLANT, CARRIER MUST ENSURE THAT CONTAINERS/RAILCARS/TRUCKS ARE PLACED AT
THE PLANT BY THE COMMENCEMENT OF THE COMMODITY SUPPLIER'S SHIPPING PERIOD
AND SUPPLY CONTAINERS/RAILCARS/TRUCKS ON A CONTINUOUS BASIS UNTIL THE
COMMODITY SUPPLIER FULFILLS HIS CONTRACT QUANTITY OR AS OTHERWISE MUTUALLY
AGREED BETWEEN CARRIER AND COMMODITY SUPPLIER PROVIDED ALL CARGO IS
DELIVERED WITHIN THE COMMODITY SUPPLIER'S SHIPPING PERIOD. IF COMMODITY
SUPPLIER FAILS TO DELIVER ALL OF THE CARGO WITIHIN THE SHIPPING PERIOD,
THEN COMMODITY SUPPLIER IS TO BE RESPONSIBLE FOR ANY DEMURRAGE OR DETENTION
THAN MAY OCCUR ON TRUCKS/CONTAINERS/TRAILERS/BARGES OR RAIL CARS OR
DEADFREIGHT ON VESSEL.
- OCEAN CARRIER MUST GIVE AT LEAST 24 HOURS NOTICE OF INTENT TO PICK UP
NFD MILK. WHEN CALLING TO SCHEDULE AN APPOINTMENT, YOU WILL NEED THE DAIRY
AMERICA RELEASE NUMBER.
- DISCHARGING RATE/TERMS: THE CARGO IS TO BE DISCHARGED ACCORDING TO BERTH
TERMS WITH NO DEMURRAGE/NO DESPATCH/NO DETENTION.
ONCE CONTAINER HAS BEEN DISCHARGED AND PLACED AT REST AT PORT OF
DISCHARGE (CONTAINER YARD), CARRIER IS TO PROVIDE THIRTY (30) DAYS
CONTAINER FREE TIME TO THE RECEIVERS WHO WILL MOVE THE CONTAINERS TO
LOCATIONS OUTSIDE THE PORT, STRIP THE CONTAINERS AND RETURN SAME TO
DISCHARGE PORT (CONTAINER YARD) AT RECEIVERS' TIME, RISK AND EXPENSE.
CARRIER IS TO PROVIDE CONTAINER DEMURRAGE RATE TO BE APPLICABLE IF
RECEIVERS FAIL TO STRIP AND RETURN THE CONTAINERS WITHIN THE THIRTY (30)
DAYS FREE TIME ALLOTED.
- DELIVERY DELAY ASSESSMENT: SHIPPER REQUIRES THAT THE BAGGED NFD MILK
CARGO ARRIVE AT FIRST OR SOLE DISCHARGE PORT NOT LATER THAN NOVEMBER 24,
2002. SHIPPER WILL ASSESS LIQUIDATED DAMAGES OF TWO DOLLARS ($2.00), U.S.
CURRENCY, PER METRIC TON IF THE NOTICE OF READINESS TO DISCHARGE FOR THIS
CARGO HAS NOT BEEN ACCEPTED PER BOOKING NOTE TERMS ON OR BEFORE
NOVEMBER 24, 2002, AND SHIPPER WILL CONTINUE TO ASSESS LIQUIDATED DAMAGES
FOR EACH AND EVERY DAY'S DELAY UNTIL THE NOTICE OF READINESS TO DISCHARGE
FOR THIS CARGO IS ACCEPTED PER BOOKING NOTE TERMS OR UNTIL COMMENCEMENT OF
DISCHARGE, WHICHEVER IS EARLIER. DELIVERY DELAY ASSESSMENT, IF ANY, WILL
BE DEDUCTED FROM OCEAN FREIGHT PAYMENT.

- FOREIGN FLAG VESSELS SHOULD NOT BE OLDER THAN 20 YEARS OF AGE AND MUST BE
CLASSED HIGHEST IN LLOYD'S REGISTER OR ITS EQUIVALENT. DATE OF ORIGINAL
CONSTRUCTION, NOT REBUILT DATE, TO GOVERN. ANY EXTRA INSURANCE DUE TO
VESSEL'S AGE, IF INCURRED UNDER THE MARINE CARGO INSURANCE POLICY COVERING
THIS SHIPMENT, SHALL BE FOR CARRIER'S ACCOUNT.
- U.S. FLAG OFFERS WILL NOT BE CONSIDERED IF THE VESSEL OPERATOR HAS NOT
PROVIDED THE MARITIME ADMINISTRATION WITH THE VESSEL'S COSTS PRIOR TO
SUBMISSION OF OFFER.
- IRD RESERVES THE RIGHT TO ACCEPT OR REJECT OFFERS.
- SHOULD GENERAL AVERAGE CONDITIONS ARISE, IRD (SHIPPER) SHALL ASSIGN THEIR
RIGHTS TO THE USDA/DEBT MANAGEMENT SECTION, WHO IN TURN SHALL CONTRIBUTE
WITH THE OWNERS IN GENERAL AVERAGE TO THE PAYMENT OF ANY SACRIFICES, LOSSES
OR EXPENSES OF A GENERAL AVERAGE NATURE THAT MAY BE INCURRED INCLUDING
SALVAGE AND SPECIAL CHARGES INCURRED IN RESPECT TO THE GOODS. IF A SALVING
SHIP IS OWNED OR OPERATED BY THE OWNERS, SALVAGE SHALL BE PAID FOR AS FULLY
AS IF THE SAID SALVING SHIP OR SHIPS BELONGED TO STRANGERS. GENERAL
AVERAGE SHALL BE PAYABLE ACCORDING TO YORK/ANTWERP RULES, 1990. CARGO TO
BE RELEASED WITHOUT GENERAL AVERAGE SECURITY.

VESSEL HOLD INSPECTIONS IS HEREBY INCORPORATED.
- THE UNITED STATES DEPARTMENT OF AGRICULTURE KANSAS CITY COMMODITY
OFFICE'S NOTICE TO THE TRADE DATED JULY 5, 1996, REGARDING CHANGES IN THE
VESSEL LOADING OBSERVATIONS PROCEDURE AND CLARIFICATION OF F.A.S. DELIVERY
ARE HEREBY INCORPORATED.
- THE UNITED STATES DEPARTMENT OF AGRICULTURE HAS ISSUED A NOTICE TO THE
TRADE (EOD-68) REGARDING VESSEL LOADING OBSERVATION, DATED MAY 5, 2000,
WHICH NOTICE IS HEREBY INCORPORATED IN THIS RFP. QUESTIONS REGARDING THESE
REQUIREMENTS OR COPIES OF THE NOTICES MAY BE OBTAINED FROM MR. NELSON
