3. DISCHARGE PORT: 1 TO 2 SAFE BERTHS, PUERTO CORTES, HONDURAS
4. TERMS: FULL BERTH TERMS, ALL INCLUSIVE. NO DEMURRAGE/NO
DESPATCH/NO DETENTION ON VESSELS, CONTAINERS, TRAILERS,
TRUCKS AND/OR RAILCARS BENDS.
5. FREIGHT RATES ARE TO PROVIDE A BREAKDOWN OF OCEAN FREIGHT AND DOMESTIC INLAND COSTS. 
6 MINIMUM CONTAINER LOAD REQUIREMENTS WILL NOT BE ACCEPTED.
7. CARRIER IS RESPONSIBLE FOR STRIPPING CARGO
FROM CONTAINER AND LOADING CARGO ONTO RECEIVERS
TRUCKS AT CARRIERS TIME, RISK AND EXPENSE.
8. CONTAINERS SHALL BE INSPECTED PRIOR TO LOADING AND AN
INSPECTION CERTIFICATE OBTAINED WHICH ENSURES THAT THE
CONTAINER IS CLEAN, DRY, FREE OF INSECT INFESTATION AND ODOR,
AND IS IN CONDITION TO LOAD AND CARRY FOOD COMMODITIES.
9. CARRIER MUST CERTIFY THAT EACH CONTAINER UTILIZED TO LOAD
THESE CARGOES IS:
(A) IN WIND AND WATER TIGHT CONDITION;
(B) NOT MORE THAN TEN (10) YEARS OLD;
(C) NOT A SALVAGED CONTAINER OR MUSTERED OUT FROM
REGULAR SERVICE.
AS A CONDITION OF PAYMENT, CARRIER MUST PROVIDE TO UNIVERSAL SHIPPING CO. A SURVEY REPORT ATTESTING TO THE SATISFACTORY CONDITION OF CONTAINERS. SURVEY IS TO BE PERFORMED PRIOR TO LOADING THESE CARGOES.
10. COSTS FOR ALL CONTAINER INSPECTIONS SHALL BE FOR THE ACCOUNT OF THE OCEAN CARRIER.
11. CARRIERS MUST COMPLY WITH SUPPLIERS LOAD AND CAPACITY CAPABILITIES. IF THE CARRIER FAILS TO COMPLY WITH SUPPLIERS LOAD CAPABILITIES, ANY COSTS INCURRED BY CCC INCLUDING BUT NOT LIMITED TO CARRYING CHARGES, LIQUIDATED DAMAGES, AND STORAGE WILL BE FOR THE CARRIERS ACCOUNT. CONTAINERS ARE TO BE PROVIDED TO THE SUPPLIERS WAREHOUSE AT THE COMMENCEMENT OF THE SUPPLIERS SHIPPING PERIOD (AS NOTED IN CLAUSE 2 ABOVE) AND CARRIER MUST ENSURE THAT CONTAINERS ARE PLACED AT THE WAREHOUSE ON A CONTINUOUS BASIS UNTIL THE SUPPLIER FULFILLS HIS CONTRACT QUANTITY. THE NFDM WILL ONLY BE ALLOWED TO BE LOADED INTO A CONTAINER AND SEALED AT THE LOADING WAREHOUSE. IT IS THE OWNERS FULL RESPONSIBILITY TO ENSURE THAT THE MANNER THE CONTAINER IS DELIVERED COMPLIES WITH THE LOADING WAREHOUSE CAPABILITIES. 
12. EACH BAG OF NFDM MUST BE INSPECTED AT THE TIME OF LOADING AT THE LOADING WAREHOUSE BY AN INSPECTOR WHICH IS DESIGNATED BY USDA/KCCO. THE CARRIER MUST COORDINATE WITH THE LOADING WAREHOUSE AND USDA/KCCO THEIR CONTAINER LOADING SCHEDULE 72 HOURS PRIOR TO CONTAINER BEING DELIVERED TO THE LOADING WAREHOUSE - IN ORDER USDAS INSPECTOR CAN MAKE ARRANGEMENTS TO WITNESS THE LOADING OF THE CARGO INTO THE CONTAINERS. ONCE THE CARGO HAS BEEN INSPECTED BY USDAS INSPECTOR AND LOADED INTO THE CONTAINERS THE CARGO CANNOT BE REMOVED FROM THE CONTAINERS UNTIL DELIVERED TO THE CONTRACTED DISCHARGE PORT.
13. OFFERS WITH ETAS BEYOND THE ABOVE CARGO AVAILABILITY DATE
STATED ABOVE WILL NOT BE CONSIDERED.
14. LOADING DELAY ASSESSMENT (LDA) OF USD 1.00 PER METRIC TON PER DAY, OR PRO RATA, WILL BE IMPOSED. THE LDA WILL BE ASSESSED FOR EACH DAY, OR PRO-RATA, BEYOND THE CONTRACTED LOAD DATE, THAT CARRIER FAILS TO BE READY TO RECEIVE CARGO AT THE INTERMODAL PLANT. LDA, IF ANY, WILL BE DEDUCTED FROM OCEAN FREIGHT PAYMENT.
15. DELIVERY DELAY ASSESSMENT: PROJECT CONCERN REQUIRES THAT CARGO ARRIVE AT DISCHARGE PORT NOT LATER THAN 18 DAYS FROM COMPLETION OF LOADING. PROJECT CONCERN RESERVES THE RIGHT TO ASSESS LIQUIDATED DAMAGES OF USD 1.00 PER METRIC TON REDUCTION IN FREIGHT RATE IF VESSEL DOES NOT PRESENT AND HAVE N.O.R. TO DISCHARGE ACCEPTED PER B/N TERMS WITHIN 18 DAYS OF THE COMPLETION OF LOADING AND TO CONTINUE TO ASSESS LIQUIDATED DAMAGES FOR EACH AND EVERY DAYS DELAY UNTIL VESSELS N.O.R. TO DISCHARGE IS ACCEPTED PER B/N TERMS OR UNTIL COMMENCEMENT OF DISCHARGE, WHICHEVER IS EARLIER.
16. OFFERS FROM NVOCCS WILL BE CONSIDERED AS NON-RESPONSIVE.
17. NON U.S. FLAG VESSELS MUST BE REGISTERED IN LLOYDS OR
EQUIVALENT AND SHOULD NOT BE MORE THAN 20 YEARS OLD.
18. VESSELS DETAILED ITINERARY AND CURRENT POSITION IS TO BE
STATED IN OFFER AND SHOULD PROVIDE ESTIMATED SAILING DATE
FROM LOADPORT,AND ESTIMATED ETA AT DISCHARGE PORT.
19. ISM CODE: OWNERS GUARANTEE THAT THIS VESSEL COMPLIES FULLY
WITH THE INTERNATIONAL SAFETY MANAGEMENT (ISM) CODE, IF
REQUIRED, AND IS IN POSSESSION OF A VALID DOCUMENT OF
COMPLIANCE AND SAFETY MANAGEMENT CERTIFICATE AND WILL REMAIN
SO FOR THE ENTIRETY OF HER EMPLOYMENT UNDER THIS BOOKING
NOTE. OWNERS ARE TO PROVIDE CHARTERERS WITH SATISFACTORY
EVIDENCE OF COMPLIANCE IF REQUIRED TO DO SO AND TO REMAIN
FULLY RESPONSIBLE FOR ANY AND ALL CONSEQUENCES RESULTING
DIRECTLY OR INDIRECTLY FROM ANY MATTER ARISING IN CONNECTION
WITH THIS VESSEL AND THE ISM CODE.
20. SUBSTANDARD VESSELS: SECTION 408 OF THE COAST GUARD
AUTHORIZATION ACT OF 1998, PUBLIC LAW 105-383 (46 USC PARAGRAPH 2302(E)), ESTABLISHES EFFECTIVE JANUARY 1, 1999,
WITH RESPECT TO NON-US FLAG VESSELS AND OPERATORS/OWNERS,
THAT SUBSTANDARD VESSELS AND VESSELS OPERATED BY OPERATORS/OWNERS OF SUBSTANDARD VESSELS ARE PROHIBITED FROM
THE CARRIAGE OF GOVERNMENT IMPELLED (PREFERENCE)CARGO(ES) FOR
UP TO ONE YEAR AFTER SUCH SUBSTANDARD DETERMINATION HAS BEEN PUBLISHED ELECTRONICALLY. AS THE CARGO ADVERTISED IN THIS
IFB IS A GOVERNMENT IMPELLED (PREFERENCE) CARGO, OFFERORS
MUST WARRANT THAT VESSEL(S) AND OWNERS/OPERATORS ARE NOT DISQUALIFIED TO CARRY SUCH GOVERNMENT IMPELLED (PREFERENCE)
CARGO(ES).
21. A BROKERAGE COMMISSION IS PAYABLE BY OWNERS ON GROSS FREIGHT, 
DEADFREIGHT, AND DEMURRAGE. TWO-THIRDS OF 2.5 PERCENT TO BE
PAID TO UNIVERSAL SHIPPING AND ONE-THIRD OF 2.5 PERCENT TO BE
PAID TO OWNERS' BROKER, IF OWNER'S BROKER IS INVOLVED IN THE VESSEL FIXTURE, OR A FULL 2.5 PERCENT TO BE PAID TO UNIVERSAL
SHIPPING IF THE VESSEL FIXTURE IS ARRANGED WITHOUT OWNERS' BROKER.
22. FURTHER DETAILS AND ADDITIONAL TERMS ARE SUBJECT TO THE TERMS
AND CONDITIONS OF PROJECT CONCERN INTERNATIONALS CONTAINERIZED/ HONDURAS PROFORMA BOOKING NOTE (SEPTEMBER 2003) WHICH IS AVAILABLE UPON REQUEST FROM UNIVERSAL SHIPPING CO.
23. CHARTERERS RESERVE THE RIGHT TO ACCEPT OR REJECT ANY AND/OR
