AND FATS FOR EDIBLE AND OLEO-CHEMICAL USE (FOSFA OPS) EXCEPT AS
MODIFIED ELSEWHERE HEREIN AND IN THE PROFORMA CHARTER PARTY.

SPECIAL NOTE 1: ANY EXTRA INSURANCE ON ACCOUNT OF VESSELS AGE, FLAG,
OWNERSHIP, TYPE, CONFIGURATION OR CLASSIFICATION WILL BE FOR OWNERS
ACCOUNT. SHOULD OFFERED VESSEL BE ENROLLED IN AN INSURANCE PROGRAM
THAT NEGATES THE OVERAGE PREMIUM REQUIREMENT, OFFER TO INCLUDE ALL
INFORMATION AND CERTIFICATIONS FOR VERIFICATION.

VESSEL GEAR REQUIREMENTS: VESSELS MUST BE FITTED WITH EFFICIENT
STRIPPING PUMPS. VESSEL TO PROVIDE ALL NECESSARY EQUIPMENT (INCLUDING
PUMPS, HOSES, AND REDUCERS) IN GOOD WORKING ORDER TO EFFECT THE
DISCHARGE OF THE CARGO INTO SHORE TANKS AND/OR TANKER TRUCKS AND/OR
RAILCARS. PUMPS MUST HAVE A MINIMUM PRESSURE OF 50 PSI WITH PUMPING
CAPACITY OF AT LEAST 90 METRIC TONS PER HOUR AND ABLE TO PUMP WATER
WITH ADEQUATE PRESSURE TO CLEAN HOSES AND PIPES AT THE DISCHARGE
TERMINAL. OWNERS TO PROVIDE AT THEIR EXPENSE ALL NECESSARY MOTIVE
POWER / FUEL TO OPERATE OWNER PROVIDED DISCHARGING GEAR.
.
PRIOR TO TENDERING NOTICE OF READINESS (NOR) AT FIRST LOADPORT, OWNERS TO PROVIDE VESSEL TANK INSPECTION CERTIFICATE EVIDENCING CLEANLINESS OF ALL TANKS TO BE LOADED WITH UMCOR SFOIL. INSPECTION TO BE PERFORMED, AND CERTIFICATE TO BE ISSUED, BY AN INDEPENDENT SURVEYOR AT OWNERS EXPENSE.
.
OWNERS ARE REQUIRED TO PROVIDE AN ADDITIONAL CERTIFICATE FROM NCB
CERTIFYING THAT VESSELS HATCH COVERS AND ANY OTHER OPENINGS LEADING TO
CARGO COMPARTMENTS HAVE BEEN SEALED TO PREVENT ANY OUTSIDE WATER FROM
ENTERING THE CARGO SPACES. COST OF SEALING AND SPECIAL SURVEY ARE FOR
ACCOUNT OF OWNER AND IN NO WAY DIMINISHES OWNERS LIABILITY AND
RESPONSIBILITIES TOWARD THE CARGO.
.
OWNERS ARE RESPONSIBLE FOR VESSEL ARRIVING AT DISCHARGE PORT
WITH AN ACCEPTABLE SAFE ARRIVAL DRAFT/BEAM. IF VESSELS DRAFT/BEAM
EXCEEDS SUCH SAFE DRAFT/BEAM, OWNERS TO BE FULLY RESPONSIBLE FOR ANY
AND ALL COSTS INCURRED IN REACHING SAFE DRAFT. ANY LIGHTENING REQUIRED
AS A RESULT OF VESSELS FAILURE TO ARRIVE AT DISPORT IN ACCORDANCE WITH
PORT RESTRICTIONS IS FOR OWNERS TIME, RISK, AND EXPENSE AND MUST BE
PERFORMED IN THE TERRITORIAL WATERS OF ALBANIA.

- ANY ADDITIONAL COMPLETION CARGO(ES) MUST BE DULY SEPARATED BY TANK,
MUST BE COMPATIBLE AND NON-INJURIOUS TO UMCORS CARGO, MUST BE DETAILED
IN OFFER OR APPROVED BY UMCOR/USDA IF CONTRACTED AFTER FIXTURE OF UMCOR
SFOIL. VESSELS ITINERARY AND GEOGRAPHIC PROXIMITY OF COMPLETION
CARGO(ES) WILL BE TAKEN INTO CONSIDERATION BY UMCOR/USDA IN APPROVAL OF
SUCH PART CARGO(ES) IN ORDER NOT TO UNDULY IMPEDE DELIVERY OF UMCORS
CARGO TO DISCHARGE PORT(S).

- OFFERS SUBMITTED UNDER THIS INVITATION ARE REQUIRED TO HAVE A
CANCELLING DATE NO LATER THAN THE LAST CONTRACT LAYDAY AS ABOVE.
VESSELS WHICH ARE OFFERED WITH A CANCELLING DATE BEYOND THE LAYDAYS
SPECIFIED ABOVE WILL NOT BE CONSIDERED.

- OFFERS OF NAMED VESSELS ONLY. NO VESSEL SUBSTITUTION IS
PERMITTED WITHOUT UMCOR/USDA APPROVAL.

- OWNERS ARE TO LIST IN OFFER THE LAST THREE CARGOES CARRIED (FOR BOTH VESSEL AND LIGHTERAGE VESSEL, IF APPLICABLE) IN THE CARGO TANKS AND THE LAST THREE CARGOES PUMPED THROUGH THE CARGO PUMPS AND LINES (IF DIFFERENT). OWNERS ARE TO CERTIFY IN OFFER THAT THE LAST THREE CARGOES WERE CLEAN, UNLEADED AND NON-TOXIC. OWNERS ARE TO CERTIFY THAT THE IMMEDIATE PREVIOUS CARGO FOR TANKS, LINES, AND PUMP SYSTEMS (FOR BOTH THE VESSEL AND LIGHTERAGE VESSELS, IF APPLICABLE) DESIGNATED TO LOAD THE UMCOR SFOIL ARE IM FULL COMPLIANCE WITH THE NIOP / FOSFA LIST OF ACCEPTABLE PREVIOUS CARGOES. OWNERS MUST EXACTLY STATE THE LAST THREE CARGOES CARRIED WITHOUT STATEMENTS OF AND OR OR WILL BE. FURTHER, CARGO NAMES MUST BE SPELLED OUT WITHOUT USE OF ABBREVIATIONS.
SHOULD ANY OF THE LAST THREE CARGOES HAVE BEEN NON FOOD GRADE CARGOES AND IF VESSEL FAILS TO PASS INITIAL INSPECTION BY THE SURVEYOR, ADDITIONAL TESTS FOR TRACE CARGOES TO BE EVIDENCED BY MEANS OF A WALL WASH TEST AT OWNERS EXPENSE.
FOR SHIPS TANKS THAT HAVE BEEN NEWLY COATED OR FULLY RE-COATED AND HAVE NOT CARRIED AT LEAST THREE CARGOES SUBSEQUENT TO THE NEW OR RE-COATING, THEN OWNERS ARE TO LIST ANY CARGOES THAT HAVE BEEN CARRIED IN THOSE TANKS, PUMPS AND LINES AFTER THE NEW OR RE-COATING, OTHERWISE SUBJECT TO THE ABOVE.
IN ADDITION, OWNERS MUST FURNISH WITH THEIR OFFER A COPY OF A SURVEY CERTIFICATE FROM A FOSFA APPROVED SURVEYOR, DATED NOT MORE THAN SIX MONTHS PRIOR TO THE OFFER DATE, ATTESTING THAT THE VESSEL (ALL TANKS, WHETHER OR NOT NEW / RE-COATED) IS IN COMPLIANCE WITH FOSFA REQUIREMENTS FOR THE CARRIAGE OF EDIBLE OILS.
FOR LIGHTERING VESSEL ONLY IF OWNERS CAN NOT PROVIDE INFORMATION ON IMMEDIATE PREVIOUS CARGO AT THE TIME OF THE OFFER THEN OFFER MUST ACKNOWLEDGE THAT OWNERS ARE NOT PERMITTED TO UTILIZE ANY LIGHTER VESSEL THAT HAS NOT BEEN INSPECTED AND APPROVED, BY A FOSFA APPROVED SURVEYOR. ANY TIME LOST AT LOAD AND/OR DISPORT DUE TO INSPECTIONS OR OTHER DELAYS IN PROVIDING SUITABLE LIGHTER VESSEL TO BE OWNERS EXPENSE.

- OWNERS GUARANTEE THAT THIS VESSEL COMPLIES FULLY WITH THE
INTERNATIONAL SAFETY MANAGEMENT (ISM) CODE AND (ISPS) CODE. FULL
CLAUSE PROVIDED IN PROFORMA CHARTER PARTY.

- SECTION 408 OF THE U.S. COAST GUARD AUTHORIZATION ACT OF 1998, PUBLIC LAW 105-383 (46 USC, PARAGRAPH 2302(E)), ESTABLISHES EFFECTIVE JANUARY 1, 1999, WITH RESPECT TO NON-US FLAG VESSELS AND OPERATORS/OWNERS, THAT SUBSTANDARD VESSELS AND VESSELS OPERATED BY OPERATORS/OWNERS OF SUBSTANDARD VESSELS ARE PROHIBITED FROM THE CARRIAGE OF GOVERNMENT IMPELLED (PREFERENCE) CARGO(ES) FOR UP TO ONE YEAR AFTER SUCH SUBSTANDARD DETERMINATION HAS BEEN PUBLISHED ELECTRONICALLY. AS THE CARGO ADVERTISED IN THIS IFB IS GOVERNMENT IMPELLED (PREFERENCE) CARGO, OFFEROR MUST WARRANT THAT VESSEL(S) AND OPERATOR/OWNER ARE NOT DISQUALIFIED TO CARRY SUCH CARGO(ES).
