EXPENSE. OWNER IS TO ARRANGE DELIVERY OF THE LOADED BARGES UNDER THROUGH
BILL(S) OF LADING TO RECEIVERS' DESIGNATED FACILITIES AT THE PORT OF PHNOM
PENH VIA THE MEKONG RIVER SYSTEM AT OWNER'S TIME, RISK AND EXPENSE. AT
PHNOM PENH, THE CARGO IS TO BE DISCHARGED, FREE OF RISK AND EXPENSE TO THE
VESSEL(S) IN ACCORDANCE WITH CUSTOMARY QUICK DESPATCH (NO GUARANTEED
DISCHARGE RATE APPLIES).
AT HO CHI MINH CITY, PRIOR TO TRANSFER OF CARGO FROM OCEAN VESSEL TO

ALL OPENINGS TO CARGO SPACES AND ALL HATCH COVERS HAVE BEEN TIGHTLY SEALED
WITH TAPE OR BY OTHER MEANS TO ASSURE WATER TIGHT INTEGRITY. SUCH
INSPECTIONS ARE TO BE ARRANGED AND PAID FOR BY OWNER.
WITHOUT GUARANTEE FROM CHARTERER, INTENDED DISCHARGE BERTHS IN PHNOM
PENH ARE THOSE FOR THE ASIA FLOUR MILL AND THE MEN SA RUN FLOUR MILL AND
MEANS OF DISCHARGE IS BY PNEUMATIC SUCTION EQUIPMENT AT ASIA FLOUR MILL AND
BY CRANES WITH GRABS AND/OR PNEUMATIC SUCH EQUIPMENT AT MEN SA RUN FLOUR
MILL.
- OWNERS ARE RESPONSIBLE FOR VESSELS (INCLUDING BARGES) ARRIVING AT LOAD
PORT(S), TRANSIT PORT (HO CHI MINH CITY), DISCHARGE PORT (PHNOM PENH)
INCLUDING INTENDED DISCHARGE BERTHS (ASIA FLOUR MILL AND MEN SA RUN FLOUR
MILL) MEETING ANY VESSEL RESTRICTIONS INCLUDING DRAFT/LOA/BEAM. ANY AND
ALL COSTS, INCLUDING LIGHTENING, NECESSARY FOR VESSELS / BARGES TO MEET
RELEVANT PORT/BERTH RESTRICTIONS INCLUDING DRAFT/LOA/BEAM ARE FOR OWNER'S
TIME, RISK AND EXPENSE. WITHOUT GUARANTEE FROM CHARTERER, CHARTERER HAS
BEEN ADVISED THAT SAFE DRAFTS AT THE PORT OF PHNOM PENH FLUCTUATE DEPENDING
ON SEASON AND THAT SAFE DRAFTS CAN BE AS LOW AS 4 METERS DURING THE DRY
SEASON (FEB-JULY).
LIGHTENING BY OWNERS TO MEET PORT/BERTH RESTRICTIONS, IF REQUIRED, TO
BE ACCOMPLISHED IN THE TERRITORIAL WATERS OF VIETNAM AND/OR CAMBODIA, AS
APPLICABLE.
- OFFEROR IS TO PROVIDE NAME OF TRANSPORTATION CONTRACTOR FOR BARGE
MOVEMENT FROM HO CHI MINH CITY TO PHNOM PENH PRIOR TO CHARTERER'S / USDA'S
FINAL APPROVAL OF FREIGHT FIXTURE.
- 60% OF THROUGH BILL OF LADING FREIGHT WILL BE MADE IN ACCORDANCE TO C/P
TERMS FOLLOWING VESSEL'S ARRIVAL AT TRANSIT PORT OF HO CHI MINH CITY,
VIETNAM. 40% OF THROUGH BILL OF LADING FREIGHT WILL BE MADE IN ACCORDANCE
WITH C/P TERMS FOLLOWING CONFIRMATION FROM CHARTERER THAT OWNERS HAVE
DELIVERED THE CARGO TO PHNOM PENH, CAMBODIA AND HAVE FULFILLED ALL THEIR
OBLIGATIONS UNDER THIS CONTRACT. SEE PROFORMA C/P CLAUSE 28 FOR FULL
DETAILS.
- DEMURRAGE/DESPATCH IS APPLICABLE AT LOAD PORT(S) ONLY. OWNERS ARE TO
SPECIFY DEMURRAGE/DESPATCH RATES IN THEIR OFFER. DESPATCH RATES MUST BE
ONE-HALF OF DEMURRAGE RATES QUOTED.
- LAYTIME ACCOUNTS ARE TO BE SETTLED DIRECTLY BETWEEN OWNERS AND COMMODITY
SUPPLIER(S) AT LOAD PORT(S). SEE PROFORMA C/P CLAUSE 9 FOR FULL DETAILS.
- VESSELS MUST BE ABLE TO BE FUMIGATED WITH AN ALUMINUM PHOSPHIDE
PREPARATION IN-TRANSIT IN ACCORDANCE WITH THE USDA, FGIS FUMIGATION
HANDBOOK AND VESSELS THAT CANNOT BE SO FUMIGATED WILL NOT BE CONSIDERED. AT
FINAL LOADING PORT, COMMODITY SUPPLIER WILL ARRANGE AND PAY FOR IN-TRANSIT
FUMIGATION PERFORMED BY A CERTIFIED APPLICATOR IN ACCORDANCE WITH THE USDA,
FGIS FUMIGATION HANDBOOK. FUMIGATION MUST BE WITNESSED BY FGIS, USDA, AND
THE ALUMINUM PHOSPHIDE PREPARATION MUST BE CONTAINED IN PACKAGING AS
DESCRIBED IN THE FUMIGATION HANDBOOK. DUST RETAINERS MUST BE USED. FOR
TWEENDECKERS AND BULK CARRIERS (INCLUDING PUSH-MODE ITB), THE RECIRCULATION
METHOD OF FUMIGATION WILL BE USED. FOR TANKERS, THE SURFACE METHOD OF
FUMIGATION WILL BE USED.
TWEEN-DECK VESSELS WILL BE CONSIDERED PROVIDED THEY ARE ACCEPTABLE
FOR IN-TRANSIT FUMIGATION IN ACCORDANCE WITH FGIS FUMIGATION HANDBOOK.
OFFERS OF SUCH TWEEN-DECK VESSELS MUST BE ACCOMPANIED BY A COPY OF A LETTER
FROM FGIS, USDA STATING THAT THE VESSEL CAN BE FUMIGATED UNDER THE FGIS
IN-TRANSIT FUMIGATION PROCEDURES.
IN ADDITION, TWEEN-DECK VESSELS ARE ACCEPTABLE ONLY WHEN A
CERTIFIED APPLICATOR STATES THAT THE VESSEL HAS BEEN INSPECTED AND FOUND TO
BE SUITABLE FOR FUMIGATION AND SUCH WRITTEN STATEMENT FROM CERTIFIED
APPLICATOR SHOULD BE SUBMITTED WITH OFFER.
- AT THE TRANSIT PORT (HO CHI MINH CITY) AND/OR DISCHARGE PORT (PHNOM
PENH), AND UPON INSPECTION BY GOVERNMENT INSPECTORS, IF CARGO AND/OR VESSEL
IS FOUND TO BE INFESTED AND PROVIDED CLEAN BILL(S) OF LADING WERE ISSUED,
OWNERS WILL ARRANGE FOR THE CARGO TO BE FUMIGATED WITHIN 24 HOURS OF
DISCOVERY OF SUCH INFESTATION. FUMIGATION COSTS, IF ANY, ARE FOR OWNER'S
(VESSEL'S) ACCOUNT.
- CUSTOM CLEARANCE: OWNER IS TO BE RESPONSIBLE FOR ANY TRANSIT CLEARANCES.
THE CONSIGNEE IS TO BE RESPONSIBLE FOR CUSTOMS CLEARANCE OF THE CARGO FOR
THE DESTINATION COUNTRY.
- FOREIGN FLAG VESSELS SHOULD NOT BE OLDER THAN 20 YEARS AND MUST BE
CLASSED HIGHEST IN LLOYD'S REGISTER OR ITS EQUIVALENT. DATE OF ORIGINAL
CONSTRUCTION, NOT REBUILT DATE, TO GOVERN. ANY EXTRA INSURANCE ON ACCOUNT
OF VESSEL'S AGE, FLAG, OWNERSHIP, TYPE, CONFIGURATION, CLASSIFICATION WILL
BE FOR OWNER'S ACCOUNT, BUT NOT EXCEEDING NEW YORK MARKET RATES.
- VESSELS 15 YEARS AND OLDER, AND PUSH-MODE ITB UNITS MUST HAVE ALL

TIME, RISK AND EXPENSE. WITHOUT GUARANTEE FROM CHARTERER, CHARTERER HAS

ON SEASON AND THAT SAFE DRAFTS CAN BE AS LOW AS 4 METERS DURING THE DRY

DELIVERED THE CARGO TO PHNOM PENH, CAMBODIA AND HAVE FULFILLED ALL THEIR

- DEMURRAGE/DESPATCH IS APPLICABLE AT LOAD PORT(S) ONLY. OWNERS ARE TO
SPECIFY DEMURRAGE/DESPATCH RATES IN THEIR OFFER. DESPATCH RATES MUST BE
ONE-HALF OF DEMURRAGE RATES QUOTED.
- LAYTIME ACCOUNTS ARE TO BE SETTLED DIRECTLY BETWEEN OWNERS AND COMMODITY

- VESSELS MUST BE ABLE TO BE FUMIGATED WITH AN ALUMINUM PHOSPHIDE
PREPARATION IN-TRANSIT IN ACCORDANCE WITH THE USDA, FGIS FUMIGATION
HANDBOOK AND VESSELS THAT CANNOT BE SO FUMIGATED WILL NOT BE CONSIDERED. AT
FINAL LOADING PORT, COMMODITY SUPPLIER WILL ARRANGE AND PAY FOR IN-TRANSIT
FUMIGATION PERFORMED BY A CERTIFIED APPLICATOR IN ACCORDANCE WITH THE USDA,
FGIS FUMIGATION HANDBOOK. FUMIGATION MUST BE WITNESSED BY FGIS, USDA, AND
THE ALUMINUM PHOSPHIDE PREPARATION MUST BE CONTAINED IN PACKAGING AS
DESCRIBED IN THE FUMIGATION HANDBOOK. DUST RETAINERS MUST BE USED. FOR
TWEENDECKERS AND BULK CARRIERS (INCLUDING PUSH-MODE ITB), THE RECIRCULATION
METHOD OF FUMIGATION WILL BE USED. FOR TANKERS, THE SURFACE METHOD OF
FUMIGATION WILL BE USED.
TWEEN-DECK VESSELS WILL BE CONSIDERED PROVIDED THEY ARE ACCEPTABLE
FOR IN-TRANSIT FUMIGATION IN ACCORDANCE WITH FGIS FUMIGATION HANDBOOK.
OFFERS OF SUCH TWEEN-DECK VESSELS MUST BE ACCOMPANIED BY A COPY OF A LETTER
FROM FGIS, USDA STATING THAT THE VESSEL CAN BE FUMIGATED UNDER THE FGIS
IN-TRANSIT FUMIGATION PROCEDURES.
IN ADDITION, TWEEN-DECK VESSELS ARE ACCEPTABLE ONLY WHEN A
CERTIFIED APPLICATOR STATES THAT THE VESSEL HAS BEEN INSPECTED AND FOUND TO
BE SUITABLE FOR FUMIGATION AND SUCH WRITTEN STATEMENT FROM CERTIFIED
APPLICATOR SHOULD BE SUBMITTED WITH OFFER.

PENH), AND UPON INSPECTION BY GOVERNMENT INSPECTORS, IF CARGO AND/OR VESSEL
IS FOUND TO BE INFESTED AND PROVIDED CLEAN BILL(S) OF LADING WERE ISSUED,
OWNERS WILL ARRANGE FOR THE CARGO TO BE FUMIGATED WITHIN 24 HOURS OF
DISCOVERY OF SUCH INFESTATION. FUMIGATION COSTS, IF ANY, ARE FOR OWNER'S
(VESSEL'S) ACCOUNT.
- CUSTOM CLEARANCE: OWNER IS TO BE RESPONSIBLE FOR ANY TRANSIT CLEARANCES.

CLASSED HIGHEST IN LLOYD'S REGISTER OR ITS EQUIVALENT. DATE OF ORIGINAL
CONSTRUCTION, NOT REBUILT DATE, TO GOVERN. ANY EXTRA INSURANCE ON ACCOUNT
OF VESSEL'S AGE, FLAG, OWNERSHIP, TYPE, CONFIGURATION, CLASSIFICATION WILL
BE FOR OWNER'S ACCOUNT, BUT NOT EXCEEDING NEW YORK MARKET RATES.
