VESSEL NAME, IMO OR OFFICIAL NUMBER, FLAG, TYPE, YEAR BUILT, LOA/BEAM, DRAFT, CLASS, DWT, WARRANTED SPEED, NUMBER OF TANKS / PUMPS, AND OWNERS FULL STYLE TO BE INCLUDED IN OFFER.

ALL VESSELS OFFERED AND UTILIZED FOR THESE CARGOES ARE TO BE OF SUITABLE SIZE AND DRAFT TO ALLOW SAFE BERTHING AT LOAD AND DISCHARGE PORT / BERTHS. THIS REQUIREMENT TO ENCOMPASS ALL ANY/ALL ASSIST TUGS HIRED BY VESSEL TO MAINTAIN VESSELS SAFETY IN BERTH WHILE CONNECTED TO SHORE TANKS AND OTHERWISE.

OWNERS ARE RESPONSIBLE FOR ASSURING THAT PERFORMING VESSEL IS FULLY COMPLIANT (AT TIME OF FIXING AND DURING TIME OF PERFORMANCE) WITH ALL INTERNATIONAL REGULATIONS AND PROTOCOLS REGARDING THE CARRIAGE OF THE CPI CARGO(ES), INCLUDING MARPOL 73/78 ANNEX II REVISIONS. OWNERS TO CERTIFY IN OFFER THAT VESSEL (PERFORMING AND/OR SUBSTITUTE) MEETS OR EXCEEDS THE SHIP TYPE 2 TANK CONFIGURATION REQUIREMENTS OF THE IBC CODE OR, ALTERNATIVELY, THAT THE VESSEL MEETS ALL REQUIREMENTS FOR SHIP TYPE 3 CHEMICAL TANKERS AND RELATED EXEMPTION REQUIREMENTS AS OUTLINED IN MARPOL ANNEX II REGULATION 4.1.3; THAT THE CERT OF FITNESS FOR VESSEL INDICATES THAT VESSEL IS ENTITLED TO OPERATE UNDER THE PROVISIONS OF THIS REG; THAT ALL FLAG STATE AND PORT STATE AUTHORIZATIONS HAVE BEEN RECEIVED OR CONFIRMED, AS NECESSARY; AND, THAT THE OWNERS CAN CONFIRM THAT VESSEL WILL BE PERMITTED TO BERTH AND LOAD / DISCHARGE AT ALL PORTS NAMED OR CONTEMPLATED IN THIS TENDER.

OWNERS TO PROVIDE ALL NECESSARY EQUIPMENT IN GOOD WORKING ORDER, INCLUDING MAIN / STRIPPING PUMPS, HOSES AND REDUCERS, IN ORDER TO EFFECT DISCHARGE OF CPI CARGO INTO SHORE TANKS AND/OR RAIL TANKCARS AND/OR TANKER TRUCKS. PUMPS TO HAVE A MINIMUM PRESSURE OF 50 PSI, WITH PUMPING CAPACITY OF AT LEAST 150 MT PER HOUR INTO RECEIVERS FACILITIES AND/OR CONVEYANCES AND BE ABLE TO PUMP WATER WITH ADEQUATE PRESSURE TO CLEAN HOSES / PIPES AT DISCHARGE.

EXCEEDING NEW YORK MARKET RATES FOR U.S. FLAG VESSELS AND LONDON RATES
FOR NON-US FLAG VESSELS. NVOCCS MAY NOT BE EMPLOYED TO CARRY U.S.
FLAG OR FOREIGN FLAG SHIPMENTS. FOR VESSELS OVER 15 YEARS OF AGE AND
ITBS, OWNERS ARE REQUIRED TO PROVIDE AN ADDITIONAL CERTIFICATE
FROM NCB CERTIFYING THAT VESSELS HATCH COVERS AND ANY OTHER
OPENINGS LEADING TO CARGO COMPARTMENTS HAVE BEEN SEALED TO
PREVENT ANY OUTSIDE WATER FROM ENTERING THE CARGO SPACES.
COST OF SEALING AND SPECIAL SURVEY ARE FOR ACCOUNT OF OWNER
AND IN NO WAY DIMINISHES OWNERS LIABILITY AND RESPONSIBILITIES

LIGHTERING AT DISPORT:

OWNERS ARE RESPONSIBLE FOR VESSEL ARRIVING AT DISCHARGE PORT WITH AN
ACCEPTABLE SAFE ARRIVAL DRAFT AS LOADED. ANY LIGHTERING AT DISPORT
IS TO BE AT OWNERS TIME, RISK, AND EXPENSE. ALL DAUGHTER VESSELS USED
MUST BE SIMILARLY GEARED, SIMILARLY CLASSED, AND CERTIFIED BY A
LICENSED SURVEYOPR THAT ALL CARGO COMPARTMENTS ARE CLEAN AND FIT TO
RECEIVE / CARRY CPI CARGO. ANY LIGHTERING IS TO BE PERFORMED WITHIN
THE TERRITORIAL WATERS OF SENEGAL UNLESS OTHERWISE APPROVED BY CHARTS
AND USDA.

OWNERS TO STATE IN OFFER THEIR INTENTION TO LIGHTEN.

PRIOR CARGOES / INSPECTIONS:

ALL VESSELS UTILIZED FOR THE CARGO, INCLUDING DAUGHTER VESSELS, MUST
PASS NIOP / FOSFA INSPECTION BEFORE LOADING AND OWISE COMPLY WITH THE
FOSFA OPERATIONAL PROCEDURES FOR ALL SHIPS ENGAGED IN THE OCEAN AND
SHORT SEA CARRIAGE AND TRANSSHIPMENT OF OILS AND FATS FOR EDIBLE AND
OLEO-CHEMICAL USE.
.
OFFERS MUST CERTIFY THAT THE LAST THREE CARGOES IN VESSEL TANKS, TANK
LINES, HOSES, AND PUMPING SYSTEMS WERE UNLEADED AND NON-TOXIC AND DO
NOT APPEAR ON THE FOSFA LIST OF BANNED IMMEDIATE PREVIOUS CARGOES AND
THAT THE MOST RECENT OF THESE CARGOES DOES APPEAR ON BOTH THE FOSFA
LIST OF ACCEPTABLE PREVIOUS CARGOES. OWNERS MUST EXACTLY STATE THE LAST
THREE CARGOES (INCLUDING THEIR EXACT CHEMICAL NAMES) CARRIED WITHOUT
QUALIFIERS OF AND OR OR WILL BE.

IF VESSELS TANKS HAVE BEEN NEWLY COATED OR FULLY RE-COATED AND HAVE
NOT CARRIED AT LEAST THREE CAROES, THEN OWNERS ARE TO LIST ANY CARGOES
THAT HAVE BEEN CARRIED (SUBJECT TO THE ABOVE PREVIOUS PARAGRAPH).
ADDITIONALLY, OWNERS ARE TO PROVIDE COPY OF SURVEY CERTIFICATE FROM
FOSFA APPROVED SURVEYOR, DATED NOT MORE THAN SIX MONTHS PRIOR TO OFFER
DATE, ATTESTING THAT VESSEL IS IN COMPLIANCE WITH ALL FOSFA
REQUIREMENTS FOR CARRIAGE OF EDIBLE OILS.

IF ANY OF THE LAST THREE CARGOES WERE NOT FOOD GRADE CARGOES AND IF
VESSEL TANKS FAIL TO PASS INITIAL INSPECTION BY THE SURVEYOR THEN
ADDITIONAL TESTING FOR TRACE CARGOES IS TO BE PERFORMED AT OWNERS
EXPENSE.

- ANY ADDITIONAL COMPLETION CARGO(ES) MUST BE DULY SEPARATED,
MUST BE COMPATIBLE AND NON-INJURIOUS TO CPIS CARGO, MUST
BE DETAILED IN OFFER OR APPROVED BY CPI/USDA IF CONTRACTED
AFTER FIXTURE OF CPI CDSBO. VESSELS ITINERARY AND
GEOGRAPHIC PROXIMITY OF COMPLETION CARGO(ES) WILL BE TAKEN
INTO CONSIDERATION BY CPI/USDA IN APPROVAL OF SUCH PART
CARGO(ES) IN ORDER NOT TO UNDULY IMPEDE DELIVERY OF CPIS
CARGO TO DISCHARGE PORT(S).

- OFFERS SUBMITTED UNDER THIS INVITATION ARE REQUIRED TO HAVE A
CANCELLING DATE NO LATER THAN THE LAST CONTRACT LAYDAY AS

- OWNERS GUARANTEE THAT THIS VESSEL COMPLIES FULLY WITH THE
INTERNATIONAL SAFETY MANAGEMENT (ISM) CODE AND THE INTERNATIONAL SHIP
AND PORT FACILITIES SECURITY CODE (ISPS). UPON REQUEST, OWNERS TO
PROVIDE CHARTERERS WITH A COPY OF THE RELEVANT DOCUMENT OF COMPLIANCE
(DOC) AND SAFETY MANAGEMENT CERTIFICATE (SMC) IN REGARAD TO THE ISM
CODE AND THE INTERNATIONAL SHIP SECURITY CERTIFICATE (ISSC) IN REGARD
TO THE ISPS CODE. OWNERS ARE TO REMAIN FULLY RESPONSIBLE FOR ANY AND
ALL CONSEQUENCES FROM MATTERS ARISING AS A RESULT OF THE OWNER OR
