SUFFICIENT VACUVATORS, IF REQUIRED) TO DISCHARGE ALL CARGO MAINTAINING THE
GUARANTEED DISCHARGE RATE.
6. CARRIAGE OF EMPTY BAGS FREIGHT FREE (AS PER CLAUSE 55)
7. SUBSTITUTION OF VESSEL IS NOT PERMITTED WITHOUT CHARTERER’S AND USDA’S
PRIOR APPROVAL. VESSEL SUBSTITUTIONS AS PER RECENT NOTICE TO THE TRADE (DATED
OCTOBER 20, 2009) AND SHOULD BE OF THE SAME OR BETTER TYPE, CLASS, YEAR BUILT,
APPROXIMATE SIZE AND WITHIN SAME LAYDAYS AS THE AWARDED VESSEL. THE
PROPOSED SUBSTITUTE VESSEL MUST ALSO APPEAR ON THE APPLICABLE MARITIME
ADMINISTRATION US OR FOREIGN FLAG VESSEL LIST.
8. WFP CARGO NOT TO BE SUBLET.
9. OWNERS TO APPOINT CHARTERERS’ AGENTS.
10. BULK CARRIERS TO BE SUITABLE FOR INTRANSIT FUMIGATION BY
RECIRCULATION METHOD IN ACCORDANCE WITH USDA/FGIS REGULATIONS. FOR
TANKERS AND ITB’S BY STANDARD SURFACE METHOD.
11. U.S. FLAG SHIPS TO SUBMIT ONE WAY/RETURN CARGO RATE AS PER AMENDED CL.
49 AND CONFIRM THAT ALL NECESSARY DATA HAS BEEN MADE AVAILABLE TO MARAD.
12. ITINERARY FROM DAY OF OFFER TO FIRST LOAD PORT TO BE SUBMITTED AND
FORM PART OF THE C/P.
13. 14 DAYS PRE-ADVICE NOTICE. PREADVICE MUST BE RECEIVED BY NOON ON A
BUSINESS DAY TO COUNT TO BEGIN THE SAME DAY.
14. IF OWNERS INTEND TO LIGHTEN, THE OFFER SHOULD SPECIFY THE COST OF
LIGHTENING, AND TOTAL NO. OF OCEAN GOING LIGHTER VESSELS TO BE USED, WHETHER
PARTIAL OR FULL LIGHTENING. IF LIGHTENING NOT PERFORMED AT THE DISCHARGE
PORT AND VESSEL DIRECTLY DISCHARGES AT BERTH, WFP WILL DEDUCT THE LIGHTENING
COST FROM THE OCEAN FREIGHT.
15. FAILURE TO PRESENT OFFER EXACTLY IN THIS FORM OR TO COMPLETE
INFORMATION STATEMENT OR DECLARATION WILL RENDER OFFERS NON-COMPLIANT AND AS
SUCH WILL NOT BE CONSIDERED.
16. IT IS A CONDITION OF THE CONTRACT THAT THE FIXTURE OF ANY PART-CARGO
OTHER THAN RELIEF CARGO WILL BE SUBJECT TO PRIOR APPROVAL BY WFP. WITHOUT
PREJUDICE TO ANY DAMAGES THAT WFP MAY CLAIM, FAILURE BY OWNERS TO COMPLY WITH
THIS CONDITION WILL GIVE WFP THE RIGHT TO TERMINATE THE CONTRACT OR TO IMPOSE ON
OWNERS A RATE REDUCTION OF USD 10.00 PER CONTRACTED MT, AS LIQUIDATED DAMAGES.
17. OFFERS TO BE RECEIVED HERE LATEST 1700 ROME TIME ON 6th SEPTEMBER 2011
AND TO BE VALID FOR 3 WORKING DAYS FROM THAT TIME / DATE.

To determine lowest landed cost, all carriers are required to submit offers
electronically for the cargoes advertised by this tender via the USDA Web Based
Supply Chain Management (WBSCM) system for the Solicitation Number(s) referenced
above. All offers are subject to all requirements of WBSCM and of the
afore-mentioned Solicitation(s), including the deadline(s) for submission of
bids therein. Freight offers are due no later than 10:00 a.m. U.S. Central
Time (11:00 a.m. U.S. Eastern Time) on September 6, 2011.
The Web Based Supply Chain Management system can be accessed through the
